These conditions of sale are concluded on the one hand by the company JOLLY M3L with a share capital of €1,000, whose registered office is located at 40 Chemin de Ruchelle 64510 ASSAT, registered in the Pau Trade and Companies Register under number 915159669, hereinafter referred to as "PAU Motors" and "Esprit Pilote" (and managing the website www.pau-motorshop.com - www.espritpilote.com) and, on the other hand, by any natural or legal person wishing to make a purchase via the website www.pau-motorshop.com and www.espritpilote.com, hereinafter referred to as "the buyer".
Article 1. Purpose
These terms and conditions of sale aim to define the contractual relationship between JOLLY M3L and the buyer and the conditions applicable to any purchase made through the website www.pau-motorshop.com and www.espritpilote.com The acquisition of a product through this site implies unreserved acceptance by the buyer of these terms and conditions of sale, which the buyer acknowledges having read prior to placing his order. Before any transaction, the buyer declares on the one hand that the purchase of products on the website www.pau-motorshop.com and www.espritpilote.com is not directly related to his professional activity and is limited to strictly personal use and on the other hand to have full legal capacity, allowing him to commit to these general terms and conditions of sale.

Article 2. Products
The products offered are those listed on the JOLLY M3L website www.pau-motorshop.com and www.espritpilote.com, subject to availability. JOLLY M3L reserves the right to modify its product range at any time. Each product is presented on the website in the form of a description including its main technical characteristics. The photographs are as accurate as possible but do not bind the Seller in any way. The sale of the products presented on the website www.pau-motorshop.com and www.espritpilote.com is intended for all buyers residing in countries that fully authorize the entry of these products into their territory and must fully assume any customs fees and other taxes inherent to this importation.
Article 3. Rates
The prices listed on the product sheets in the online catalog are in Euros (€) inclusive of all taxes (TTC) taking into account the VAT applicable on the day of the order. Any change in the VAT rate may be reflected in the price of the products. JOLLY M3L reserves the right to modify its prices at any time, it being understood, however, that the price listed in the catalog on the day of the order will be the only one applicable to the buyer. Article 4. Order and payment terms
Before placing an order, the buyer must create an account on the website www.pau-motorshop.com and www.espritpilote.com. The account creation section is accessible directly from the side menu bar. Each time the buyer visits the website, if they wish to order or consult their account (order status, profile, etc.), they must identify themselves using this information. JOLLY M3L offers the buyer the option of ordering and paying for their products in several stages.
- Secure payment by Paypal or credit card (via the Shopify system): the buyer selects the products they wish to order in the "basket", modifies if necessary (quantities, references, etc.), checks the delivery address or enters a new one. Then, the shipping costs are calculated and submitted to the buyer, as well as the name of the carrier. Next, the buyer chooses the payment method of their choice: "Payment by Shop". The next step is to check all the information, read and accept these general terms and conditions of sale by checking the corresponding box, and then invites them to validate their order by clicking on the "Confirm my order" button. Finally, the buyer is redirected to the secure Shopify interface to securely enter their Shopify account details or personal credit card details. If the payment is accepted, the order is registered and the contract is definitively formed. Payment by Paypal account or credit card is irrevocable. In the event of fraudulent use of the card, the buyer may demand cancellation of the card payment, and the amounts paid will then be re-credited or refunded. The liability of the holder of a bank card is not incurred if the disputed payment has been proven to have been made fraudulently, remotely, without physical use of his card. To obtain reimbursement of the fraudulent debit and any bank charges that the transaction may have generated, the cardholder must contest the direct debit in writing with his bank within 70 days of the transaction, or even 120 days if the contract binding him to it so provides. The amounts withdrawn are reimbursed by the bank within a maximum of one month after receipt of the written dispute filed by the cardholder. No fees for the restitution of the sums may be charged to the cardholder.
Confirmation of an order implies acceptance of these terms of sale, acknowledgement of having full knowledge of them and waiver of the right to invoke one's own purchasing conditions. Article 5. Retention of title
JOLLY M3L retains full ownership of the products sold until full payment of the price, including principal, costs and taxes.
Article 6. Withdrawal
Pursuant to Article L121-20 of the Consumer Code, the buyer has a period of fourteen working days from the delivery of their order to exercise their right of withdrawal and thus return the product to the seller for exchange or refund without penalty, with the exception of return costs.
In the event that discount conditions were met by the initial order but not by the final order, after a partial return, JOLLY M3L reserves the right to apply the discount(s) concerned to the refund. This may concern discounts on products, on the order or on shipping costs.
Article 7. Delivery
Deliveries are made to the address indicated on the order form, which can only be within the agreed geographical area. Orders are carried out by COLISSIMO. Delivery times are given for information purposes only; if they exceed thirty days from the order, the sales contract may be terminated and the buyer reimbursed. JOLLY M3L may provide the buyer with the tracking number for their package by email. Transport risks are the responsibility of the buyer from the moment the items leave JOLLY M3L's premises. The buyer is required to check the condition of the packaging of the goods and their contents upon receipt in the presence of the COLISSIMO depositary. In the event of damage during transport, any protest must be made to Mondial Relay within three days of delivery.
Article 8. Warranty
All products supplied by JOLLY M3L benefit from the legal guarantee provided for by articles 1641 and following of the Civil Code. In the event of non-conformity of a product sold, it may be returned to JOLLY M3L which will take it back, exchange it or refund it.
